1. Scope of application

These General Terms and Conditions (hereinafter “GTC”), together with the “questionnaire” completed by the patient (hereinafter “the patient”) at the start of treatment, govern the legal relationship and the treatment contract between Physiozentrum.ch AG and the patient. These GTC apply between the Physiozentrum and the patient in the form currently valid at the time of treatment. They govern the business relationship of the booked treatment (hereinafter “the treatment”) exclusively, unless otherwise mentioned or agreed.

2. Data protection

With regard to data protection declarations, please refer to Physiozentrum’s data protection declaration, which can be accessed at www.physiozentrum.ch/datenschutz. By signing the aforementioned form and by utilising the treatment service, the patient agrees to the data protection declarations.

The patient files belong to the patient and will be handed over to the patient at any time on request. They are kept by the Physio Centre and made available to the physiotherapists treating the patient and used for invoicing and debt collection. For the purpose of invoicing and patient and appointment management, all necessary data will be disclosed to Compis GmbH. We also authorise ourselves to exchange medical data and patient data relating to the treatment with the referring and treating doctors and medical officers of the cost bearers and with Swiss insurance companies of all kinds for administrative purposes, and to obtain additional patient data.

3. Cancellation conditions

Booked treatment appointments are always binding and the agreed time is reserved for the patient. The patient is therefore requested to inform the respective practice in good time, but at least 24 hours in advance, if he/she is unable to attend.

Physiozentrum reserves the right to charge the patient the following private expenses of CHF 75.00 if the appointment is cancelled late or not at all.

4. payment regulation

The costs for privately invoiced treatments must be paid by the patient within 30 days of the invoice date.

All treatment costs that are not paid by the insurance/health insurance company shall be borne in full by the patient. In the event of late payment, a fee of CHF 10 will be charged for the first reminder and CHF 20 for the last reminder. After two unsuccessful reminders, the case will be handed over to a debt collection company and an additional CHF 28 will be charged.

5. Treatment

The treatment of the patient is based on the generally recognised and known standards and rules of physiotherapy and medical massage. As is generally in the nature of therapeutic and medical treatment, a specific treatment outcome cannot be guaranteed.

6 Place of jurisdiction and applicable law

The place of jurisdiction for disputes arising from or in connection with this contract is St. Gallen, Switzerland. The applicable law is exclusively Swiss law, excluding the conflict of laws.

7. Final provisions

Physiozentrum reserves the right to amend these GTC at any time. The currently valid version is available on our website at www.physiozentrum.ch/agb. The amended version shall enter into force upon publication on the website.

Should provisions of these General Terms and Conditions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provisions shall be replaced by the statutory provisions, if any.
